Kynix operates the website located at www.kynix.com to provide online access to information about products that are available at Kynix (the "product") and to facilitate the purchase of Products (the "Service"). These Terms of Use, together with the Conditions of Order, are referred to as this "Agreement" By using Kynix, you agree to each of the following terms and conditions set forth herein ("Terms of Use"). By ordering Products, you agree to the Terms of Use, as well as the Conditions of Order, set forth below. Kynix reserves the right to modify this Agreement at any time without giving you prior notice. Your use of the Site following any such modification constitutes your agreement to follow and be bound by the Agreement as modified. The last date this Agreement was revised is set forth below.

1. Intellectual Property

You may not mirror, scrape, or frame the home page or any other pages of this Site on any other Web site or web page. 2. Disclaimer of Warranties

Kynix makes no express, implied warranties or representations with respect to any product, or with respect to the site, the service, or the content. Kynix expressly disclaims all warranties of any kind, express, implied, statutory, or otherwise, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and no infringement with regard to the products, the site, the service, and the content. Kynix does not warrant that the functions performed by the site or the service will be uninterrupted, timely, secure or error-free, or that defects in the site or the service will be corrected. Kynix does not warrant the accuracy or completeness of the content, or that any errors in the content will be corrected. The site, the service, and the content are provided on an" As is" and "as available" basis.

At Kynix, visitors IP addresses are periodically reviewed and analyzed for the purpose of monitoring, and effectively improving our Web site only, and they will not be shared outside Kynix.

During a website visit, we may ask you for contact information (email address, telephone number, fax number, and addresses for shipping/billing). This information is collected on a voluntary basis— and only with your approval.

3. Limitation of Liability

In no event shall Kynix be liable to the buyer or to any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages(including without limitation lost profits, lost savings, or loss of business opportunity)arising out of or relating to (I) Any product or service provider or to be provided by Kynix, or the use of inability to use the same; (II) The use of or inability to use the site, the service, or the content, (III) Any transaction conducted through or facilitated by the site; (IV) Any claim attributable to errors, omissions, or other inaccuracies in the site, the service and/or the content; (V) Unauthorized access to or alliteration of your transmissions or data, (VI) Statements or conduct of any third party on the site or the service; (VII) Any other matter relating to the products, the site, the service or the content, even if Kynix has been advised of the possibility of such damages.

Kynix's sole obligation and liability for product defects shall be, at Kynix's option, to replace such defective product or refund to the customer the amount paid by the customer therefore in no event shall Kynix's liability exceed the buyer's purchase price. The foregoing remedy shall be subject to the buyer's written notification of the defect and return of the defective product within sixty (60) days of purchase. The foregoing remedy does not apply to products that have been subjected to misuse (including without limitation static discharge), neglect, accident, or modification, or to products that have been soldered or altered during assembly or are otherwise not capable of being tested. If you are dissatisfied with the site, the service, the content, or the terms of use, your sole and exclusive remedy is to discontinue using the site. You acknowledge, by your use of the site, that your use of the site is at your sole risk.

4. Conditions of Order

All orders placed via the Site or via the print catalog are subject to the terms of this Agreement, including the following Conditions of Order. No change, alteration, deletion or modification of any of this Agreement is permitted without written permission by an authorized Kynix representative. Any purported change submitted by a purchaser in any additional documentation is hereby expressly rejected. Orders placed on forms deviating from these terms and conditions may be accepted, but solely on the basis that the terms of this Agreement will prevail.

1. Order Validation and Acceptance

When you place an order, we may verify your method of payment, shipping address, and/or tax-exempt identification number, if any, before processing your order. Your placement of an order via the Site is an offer to purchase our Products. Kynix may accept your order by processing your payment and shipping the Product, or may, for any reason, decline to accept your order or any part of your order. No order shall be considered to be accepted by Kynix until the Product has been shipped. If we decline to accept your order, we will attempt to notify you using the email address or other contact information you have provided with your order.

2. Electronic Communication

When you place an order via the Site, you are required to provide a valid email address, which we may use to communicate with you regarding the status of your order, advise you regarding the shipment of back-ordered products, and provide you with any other notices, disclosures or other communications relating to your order. You agree that Kynix will not be responsible for any damage to your incur, or information you do not receive, as a result of your failure to provide a valid email address.

3. Pricing

Kynix Website quotation and related services are only been calculated in U.S. dollars and settlement of the currency, if the U.S. currency is not within the scope of the use of national or regional customers, please exchange the rate for the corresponding conversion according to their own countries or regions. All prices are in U.S. dollars.

4. Product Information

Kynix website type of product, product description and parameters, the relevant pictures, video, and other information are provided by the Internet and relevant suppliers, Kynix website does not shoulder the responsibility for the information's accuracy, integrity, legality, or authenticity. In addition, the Kynix website or any use of providing information on businesses and their risks on this website does not shoulder any responsibility.

5. Payment    

Kynix offers several convenient payment methods in US dollars, including PAYPAL, Credit Card, Master Card, VISA, American Express, Western Union, and Wire Transfer. 6. Shipping Charges

Shipping or freight charges, insurance, and destination customs duties will be paid by the customers.

7. Banking fee

For wire transfer, we charge a USD $ 30.00 banking fee, for PAYPAL and Credit Card we charge 4.6% + USD $0.3 service fee of the total amount, for western union, there is no banking fee.

8. Handling Charge

There is no minimum order or handling fee.

9. Freight Damage and Return Policy

If you receive merchandise that has been damaged in transit, it is important to keep the shipping carton, packing material, and parts intact. Please contact Kynix customer service immediately to initiate a claim. All returns should be made within 60 days of the date of invoice and be accompanied by the original invoice number, certificate of guarantee card, part's picture, and a brief explanation or the test report of the reason for the return. Returns will not be accepted after 60 days. Returned merchandise must be in original packaging and in a resalable condition. Parts returned due to customer error at the time of quote or sale will not be accepted.

10. Customs Problem

Kynix quotations are FOB prices, we are not responsible for destination countries’ customs clearance.

If the customer's parts were detained or seized by the customer's local customs, Kynix can provide some documents for customers, but Kynix is not responsible for customs clearance, Kynix does not pay the customs fee, it's all customers' duty to clear the parts from customer's local customs.

Kynix will not ship again if parts were detained or seized in the customer's local customs, there is no refund of the payment.

11. Duties and Responsibilities

Kynix is a professional B2B and B2C trading platform, and we can only inspect the exterior condition of the goods, but not the inner function. Returns within 60 days will be accepted, however, customers have no right to prosecute Kynix for nonfunctional goods, and also have no right to ask for extra compensation. Kynix is a service platform, we are not manufacturers, we just supply the service and help customers to purchase the products which they need. Kynix reserve the right to final explanations.
